Whistleblower Policy

Purpose

LDK is committed to a culture that encourages employees and stakeholders to report genuine concerns about
misconduct, unethical behaviour, or breaches of LDK’s values, ethical standards, or legal obligations.

Scope

Applies to all board members, executives, employees, volunteers, residents, families, vendors, and contractors.

What Is Whistleblowing?

Whistleblowing means reporting misconduct in good faith — where the person reasonably believes wrongdoing has occurred.
Misconduct may include:

  • Fraudulent, dishonest, or illegal activity
  • Unethical or immoral behaviour
  • Regulatory non-compliance
  • Serious mismanagement or misuse of resources
  • Actions creating significant health, safety, or environmental risk
  • Behaviour damaging to LDK’s reputation

Reporting Channels

Whistleblowers may report concerns to:

  • A Responsible Person within LDK
  • Aged Care Quality and Safety Commission – 1800 951 822
  • State or Territory Department of Health
  • Police or an independent aged care advocate

LDK Whistleblower Protection Officers (WPO)

Whistleblower Investigation Officer (WIO)

Appointed by the WPO, responsible for investigating reports fairly and independently.
External investigators may be engaged if required.

Confidentiality and Anonymity

  • Whistleblowers may report anonymously, though this may limit feedback or investigation detail.
  • Confidentiality will be maintained as far as legally reasonable.

Investigation Process

  • All reports are investigated objectively to confirm or refute the claims.
  • Those accused are given a fair opportunity to respond.
  • Findings are summarised in a report and actioned by the WPO.

Protection Against Victimisation

  • Whistleblowers will not be penalised or disadvantaged for reporting in good faith.
  • Any retaliation (harassment, discrimination, victimisation) is considered serious misconduct.

False or Malicious Reports

Deliberate false reporting may result in disciplinary action, up to and including dismissal.
